By Purchasing a product through this site you agree to the following terms and conditions:

All sales are final.

Images are for example and the product supplied may vary from what is pictured.
Whilst every effort is made to deliver the cake as described,  conditions outside of our control may arise and equivalent replacements need to be made. In any instance you will receive, at a minimum,  your cake sized as ordered. 
Cakes are produced in three sizes: Sweet Treat, Sugar Rush and Group Hug.

Serving suggestions for each size are strictly a guide.
Add-ons, such as but not limited to, Candles, Cards and toppers must be done so before you check out. If you wish for these to  be manually added to your order once you have completed your transaction, a $25 handling fee applies. You are welcome to process these add ons yourself through the website FOC.

Payment
Payment is accepted through PayPal, Stripe, Applepay and Google Pay. XERO invoices are also available fro corporate orders.
Any additional fees incurred by you through the use of the chosen online payment terminal are at your own expense.

Please make sure that the delivery address and contact details of the recipient are correct. Failure to provide correct details may result in your cake being undeliverable.
 

Order Changes/ Cancellation policy
 
All Sales are Final.
No refunds for Change of mind.

Whereby the cake has been ordered more than 5 days in advance, and your request is more than 5 business days prior to delivery, we allow you to change the delivery date once FOC. The new delivery date must be within 60 days of the original booked date.
Any amendments to your order will incur a processing fee of $25 in addition to a fee of 4% of the order total whereby a partial refund applies.

Delivery

Flat Rate $15 Delivery fee to Brisbane CBD. Delivery outside this zone, and within 15km CBD is calculated at checkout. For other suburbs please email us for a quote.

Specific Delivery times are not guaranteed. Orders placed prior to 6pm the day prior will be delivered anytime before 230pm on the Delivery Day. Orders placed after this will be delivered by 5pm on the Delivery Date.

In order to have your cake delivered the following information will be requested:
Your name and email address.

The Delivery Date- Please note deliveries only occur Monday- Friday – excluding Public holidays.

The recipients Name, Delivery address (including company name for workplaces), Mobile Phone number and email address

You are responsible for ensuring that all contact details are correct (Both Recipient and the Sender)
Failure to supply incorrect or incomplete details may result in the cake being delivered to the wrong person (Especially in large office/buildings)
Whereby a cake is delivered to the wrong recipient due to incomplete or incorrect information received, Happy Cake Day will not be held accountable. Any loss as a result is the sole responsibility of the purchaser and no compensation will be afforded.

Delivery of cakes is operated by a third party courier.
Orders placed before 10am on the day will be delivered by 5pm

Orders placed after 10am will be held over to the following business day. Cakes will be delivered between 10am – 5pm Monday to Friday- Excluding Public Holidays.

 

Authority to Leave

You have the option to choose Authority to Leave.

By choosing this option you release Happy Cake Day and its associated delivery partners, of any liability  in respect to, but not limited to, Damage, Loss and destruction of the supplied product.

When there is no Authority to leave, and the supplied address  is unattended, or whereby and Authority to Leave has been issued, however  the Courier deems the address be unsuitable to leave the item, e.g.  Property with no secure place to leave the order, this will be classed as a failed delivery. 

A Failed Delivery will incur a Fee of $25 to return the cake to Happy Cake day.  A further redelivery fee will apply should you wish to have the cake sent out on the following delivery run. Please note that the next delivery run may be the next business day.
 If you opt to abandon the order no refund will be given.

Privacy

Any information or details shared with Happy Cake Day will be used exclusively for the purpose of the sale and  product delivery. From Time to Time Happy Cake Day may request your feedback with regards to the product you ordered.

You are not obliged to respond nor complete these requests.  Personal information provided is not shared.
If  you choose to subscribe to the monthly newsletter you will be contacted, via Mailchimp, using your nominated email address and may unsubscribe at any time.

 Media

On most occasions we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.  
Happy Cake Day will never share any personal detail without your express permission.
We always appreciate a tag or a shout out on socials @happycakedaybrisbane is our handle for both Instagram and Facebook.

Allergen Risk

Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.

 Complaints/Refunds

We trust you will receive your order as perfectly as it left our studio.
In the unfortunate circumstance that  your  Happy Cake day product arrives defective you need to notify us immediately. As this item is a perishable product, any problems arising with your delivery need to be addressed urgently.

All disputes must be lodged within 3hrs of receipt of goods.
Orders given Authority to Leave waive their rights to any damage claims.

Any costs associated with returning the product will be at the purchasers expense.

Should you place an order and realise that you no longer require the cake, notice received more than 24hrs before delivery and where the order has not began being fulfilled, you may apply for a Credit note. Credit Notes will be valid for a singe use within 60 days of the original order date.
A handling fee of $25 will apply to cover the associated costs of the transactions. Should the order be cancelled within 24hrs of delivery- full cost of the cake minus any delivery fees will be incurred.

Should you find that you have missing items/Add-Ons please contact us baked@happycakeday.com.au with details of the misplaced unit/s and a refund will be issued.

Performance of this agreement is contingent upon the ability of  Happy Cake Day to complete the agreement and is subject to labour disputes or strikes, accidents, Acts of God,  pandemics, and other causes beyond our control.

Happy Cake Day Reserves the right to alter change or amend the above Terms and Conditions without Notice.

Happy Cake day is a Trading name of Cake That!   
Cake That! ™ is a Registered Trademark. Any unauthorised use of the Name, Branding or Intellectual property is unlawful.
Happy Cake Day is BCC Food Licensed under the Cake That! licensing agreement.
